Welcome to DodgeThatPothole ("the Service"). By accessing, viewing, or submitting reports to the Service, you agree to these Terms & Conditions. If you do not agree, please do not use the Service.
1. What This Service Is
DodgeThatPothole is a free, community-driven map that lets members of the public report and view potholes in South West Victoria. All pothole information is submitted by members of the public, not by us, and not by any government authority.
2. Information Accuracy โ No Warranty
The Service is provided "as is". We do not guarantee that any pothole report is accurate, current, complete, or that a reported pothole still exists or has been repaired.
Reports may be outdated, mistaken, duplicated, or removed automatically over time. You should never rely solely on the Service when making decisions about road safety or travel.
3. Limitation of Liability
To the maximum extent permitted by law, DodgeThatPothole and its operators accept no liability for any loss, injury, vehicle damage (including tyre, wheel, or suspension damage), accident, or other harm arising from:
- your use of, or reliance on, information shown on the Service;
- the absence of a pothole report for a hazard that exists; or
- any error, interruption, or unavailability of the Service.
Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
4. Not a Government Service
DodgeThatPothole is not affiliated with, endorsed by, or connected to any local council, VicRoads, or government body. Submitting a report here does not notify any authority. To request an official repair, you should also report the pothole directly to your local council.
5. Your Responsibilities
When you submit a report, you agree that:
- the report describes a real pothole you have actually seen;
- you will not submit false, fake, joke, test, or spam reports;
- you will not upload photos that are offensive, unlawful, or that contain people's faces, number plates, or other personal information;
- you will not misuse, overload, or attempt to disrupt the Service.
We may remove any report at our discretion, without notice.
6. Privacy & Data We Collect
The Service is designed to be used anonymously. We do not require an account, name, or login to submit a report. When you report a pothole, we collect:
- the location (GPS coordinates) you submit or adjust;
- the severity, optional note, and optional photo you provide;
- a basic anti-spam marker stored in your own browser.
If you choose to contact us through the feedback form and provide your name or email, we use it only to respond to you. Please avoid including personal or sensitive information in reports or photos.
7. Photos & Content You Submit
You keep ownership of photos you upload. By submitting a photo, you grant DodgeThatPothole a non-exclusive, royalty-free licence to display, store, and use that photo for the purpose of operating the Service (for example, showing it on the public map). You confirm you have the right to share any photo you upload.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted means you accept the updated Terms. The "Last updated" date at the top shows when these Terms were last revised.
9. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
